General Terms and Conditions (GTC)

1. Scope of application
These General Terms and Conditions (GTC) apply to all orders and contracts concluded via the online store of fabscards (a brand of coderhino GmbH, hereinafter referred to as “fabscards”). By placing an order, the customer accepts these GTC.

2 Contractual partner and conclusion of contract

The products displayed in the online store do not constitute a legally binding offer, but an invitation to the customer to submit a purchase offer. By clicking on the order button, the customer places a binding order. Confirmation of receipt of the order is sent by e-mail. The purchase contract is only concluded with the express acceptance by fabscards or the dispatch of the goods.

3 Prices and terms of payment
All prices in the online store are quoted in euros and include VAT. Shipping costs are shown separately. Payment can be made by prepayment, PayPal, credit card or other payment methods offered in the store. If a payment method offered via the payment service “PayPal” or “Shopify Payments” is selected, payment is processed via the respective payment service provider under the terms of use applicable there. Further information on this can be found on the websites of the respective payment service providers.

4 Delivery and shipping
Delivery is made within Austria and to selected EU countries. The shipping costs and delivery times are specified in the order process. fabscards assumes no liability for delays in delivery caused by third parties (e.g. shipping service providers). If the shipping company returns the goods to fabscards because delivery was not possible, the customer shall bear the costs for the unsuccessful shipment, unless the customer is not responsible for the non-delivery.

5 Retention of title
fabscards retains title to the delivered goods until the purchase price has been paid in full.

6. Right of withdrawal
Consumers have the right to cancel the purchase contract within 14 days without giving reasons. The withdrawal period begins on the day on which the customer or a named third party receives the goods. To exercise the right of withdrawal, the customer must send a clear declaration by e-mail or post to fabscards. The return costs shall be borne by the customer, unless the goods were defective or incorrectly delivered.

The right of withdrawal expires prematurely if sealed products have been opened after delivery. These cannot be taken back for reasons of product safety and intrinsic value.

7 Warranty and liability
The statutory warranty rights apply. If a product is defective, the customer can demand rectification or replacement. fabscards is only liable for damages caused by gross negligence or intent. Liability for loss of profit or consequential damages is excluded.

8. Data protection
Personal data is processed in accordance with the applicable data protection regulations. Details can be found in the privacy policy on the fabscards website.

9. Alternative dispute resolution
The EU Commission provides a platform for online dispute resolution at the following link: https://ec.europa.eu/consumers/odr. This platform is used for the out-of-court settlement of disputes between consumers and online merchants. fabscards is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

10. Applicable law and place of jurisdiction
Austrian law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for disputes is the Wels Regional Court. Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
